The Economic and Strategic Planning Division administers the County’s Economic Development Incentive Agreements, including monitoring company compliance. These agreements are made under Travis County’s Chapter 28 Economic Development Incentives policy, which forms part of the Travis County Code. The current Chapter 28 Economic Development policy was updated in January of 2014. In July of 2019, the Court approved a moratorium on new applications under this program in order to make updates to the policy. The moratorium has been lifted twice: once on May 26, 2020, to accept an application from Tesla, which resulted in an economic development agreement, and once on January 26, 2021 to accept an application from Samsung, which is currently under negotiation for a potential economic development incentives agreement. While County staff works to revise the policy, the moratorium remains in effect.

House Bill 2402, passed by the 87th Texas Legislature, instructs the Texas Comptroller’s Office to create and make accessible an online Chapter 380 and 381 Agreement Database that contains information regarding all local development agreements in the state.
