Refunding of Civil Cash Bonds
A signed order from a judge must be on file with the Travis County District Clerk before we can process refunds. You can get an order by hiring an attorney or visiting our law library for more information. Please do this before petitioning the court. The Travis County Law Library is located at:
Civil and Family Court Facility
1700 Guadalupe Street
2nd Floor
Austin, TX 78701 (Map)
You can also contact The Travis County Law Library via phone at (512) 854-9677. Please know clerks are not allowed to give any information or answer questions that might be considered legal advice.
Once a judge signs an order and that order is on file with the Travis County District Clerk’s Office, a 30-day waiting period starts. After the waiting period, the refund process is about 7 to 10 business days. Per statute, all bond refunds are subject to an administrative fee of 5% of the total bond amount, not to exceed $50.00 [Ref. Sec. 117.055 (a) Local Government Code] except for bonds associated with Family Courts. Refunds are made via check and sent through US Mail.
Unclaimed Property
By law, any unclaimed bonds are forwarded (also known as escheated) to either the Travis County Treasurer’s Office or the State of Texas Comptroller’s Office, depending on the dollar amount.
- Bonds $100 and under (after the deduction of the statutory fee) are sent to the Travis County Treasurer’s Office.
- Bonds greater than $100 (after the deduction of the statutory fee) are sent to the State of Texas Comptroller’s Office.
- Once funds are sent to either office, the Travis County District Clerk’s office is no longer in possession of the funds.
- If you have questions about these funds, please reach out to the Travis County Treasurer’s Office or the Unclaimed Property Division of Texas Comptroller’s Office.
