To Schedule a Hearing or a Jury Trial
To schedule any hearings except those listed below, please fill out a Regular Docket Hearing Request Form and email the form to [email protected].
- For uncontested guardianship hearings, see instructions below. Before scheduling any guardianship hearing, please read the Court's Uncontested Guardianship Docket Procedures (updated 1/1/2023).
- For all heirship hearings, see instructions below.
- No form is needed to request a hearing for a will prove-up on the uncontested probate docket (unless there is a partial intestacy). After you have filed the original will, request a hearing date by emailing [email protected].
- For emergency settings, please first contact either the Court Investigator (for temporary guardianships or TROs related to guardianships) or the Court Administrator (for Temporary Administrations or other TROs).

To Schedule Heirship Hearings:
Heirship cases are heard on both the regular docket and the uncontested probate docket, depending on the circumstances. An heirship case should be scheduled on the regular docket not only if a contest (or any answer that could be construed as a contest) has been filed, but also if there are unusual circumstances that need to be addressed – even if there is no contest about these issues. For example, schedule an heirship on the regular docket if there is a common-law marriage, an equitable adoption or a formal adoption about which there is a question, a declaratory judgment, a settlement agreement, DNA evidence, or expert testimony. Heirship cases should be scheduled on the uncontested docket only if there is no contest and there are no unusual circumstances that need to be addressed.
